HSE Improvement Notices

An improvement notice will be issued when the inspector is of the opinion that a person: -

  • Is contravening one or more of the relevant statutory provisions; or
  • Has contravened one or more of those provisions in circumstances that make it likely that the contravention will continue or be repeated.

The improvement notice will require the contravention to be remedied within a specified period. It is possible to appeal against an issued appeal notice. Our health and safety solicitors will be able to advise you on this matter. Failure to comply with the notice is a criminal offence.

HSE Prohibition Notices

If a prohibition notice is served then the activity, which the notice relates to, must cease until the matter, specified in the notice, is rectified. It is a criminal offence to breach the prohibition notice.

Corporate Manslaughter

Corporate Manslaughter is an offence at the extreme end of the spectrum of Health & Safety criminal offences and comes about if senior management manage or organise their activities in a way that causes a persons death. It has only become a serious risk to directors of companies and officers of Government agencies following the prosecution relating to the management of railways and cases involving deaths of employees or members of the public following outbreaks of disease in public or private buildings.
