The penalties for breach of Health & Safety laws can be severe. If you are under investigation or charged with breaching health and safety laws MJP solicitors can advise you on how to proceed and provide representation.

HSE Investigation

A HSE investigation may take place if there have been complaints or reports of an incident, injury or occupational ill health in the workplace.

HSE's policy is to conduct investigations in accordance with the Enforcement Policy Statement. An investigation will take place to determine: -

  • causes;
  • whether action has been taken or needs to be taken to prevent a recurrence and to secure compliance with the law;
  • lessons to be learnt and to influence the law and guidance;
  • what response is appropriate to a breach of the law.

HSE Interview Under Caution

A HSE interview under caution will take place when an individual or business are found to be in breach, or suspected of being in breach, of the Health and Safety at Work Act 1974 and any of its subsidiary safety regulations or environmental legislation.

It is fundamental for any individual or business to seek representation from a solicitor when an interview is to take place. Knowing your rights is important, regardless if you're being interviewed by the Police, the Local Government Environmental Health Departments or the Health and Safety Executive (HSE). Anything that is done or said during this time can prove important and influence the defence (or prosecution) of the case.

At MJP solicitors we have experience and knowledge in defending both criminal prosecutions and Health and Safety prosecutions. We are able to offer advice and representation pre, during and post HSE interviews under caution or investigations.
